IRRC Approves Wastewater Treatment Requirements

The Independent Regulatory Review Commission approved regulation No. 2806 Environmental Quality Board #7-446: Wastewater Treatment Requirements 4-1 with Commissioner Silvan Lutkewitte voting in the negative. The Commission received extensive comment on the regulation from a wide variety of stakeholders including PennFuture, the Pennsylvania Chamber of Business and Industry and the Department of Environmental Protection. IRRC Approves Five Regulations, Including Assisted Living Reg

IRRC met this morning and approved five regulations, three of which were quickly approved with minimal discussion. A fourth reg, which would double the lobbyist registration fee was subject to discussion over whether the department properly published notice of the proposed increase. The fifth regulation was the long awaited assisted living residences regulation. The commissioners heard from a number of parties with concerns on the regulation and whether it will adequately meet the needs of consumers. Ultimately the regulation, like the four others considered today, was approved without dissent.

IRRC Approves Pre-K Counts Regulation

The Independent Regulatory Review Commission approved 11 regulations at its hearing today. No. 2817 Department of Education #6-319: Pennsylvania Pre-K Counts Requirements, Standards and Procedures was approved with Commissioner Silvan Lutkewitte voting in the negative. The Disabilities Rights Network argued that the regulation would impose a 20 percent cap on the number of special needs students that a Pre-K Counts provider would be able to enroll. Harriet Dichter, Secretary of the Department of Public Welfare, assured the commissioners that the regulation does not discriminate against special needs students and said there the 20 percent figure is not a cap but simply a best practices suggestion. IRRC approves 2 gaming regs

No. 2690 State Board of Medicine #16A-4924: Acupuncture Licensure, No. 2662 State Board of Pharmacy #16A-5417: Continuing Education, No. 2782 Pennsylvania Gaming Control Board #125-105: Jackpot and Credit Meter Payouts, and No. 2804 Department of Labor and Industry #12-89: Uniform Construction Code (Final Omit) were all unanimously approved. The contentious Keystone Exams regulation No. 2696 State Board of Education #6-312: Academic Standards and Assessment was approved with Commissioner Silvan B. Lutkewitte, III voting in the negative.
