The House Consumer Affairs Committee met with representatives from the electricity industry today to learn about the structure of the industry in Pennsylvania. The Electric Power Generation Association, Retail Energy Supply Association, Energy Association, PJM, and Consumer Advocate each spoke about their roles in producing and delivering electricity in the state.

The Senate Appropriations Committee held a budget hearing with the five Public Utility Commissioners. Members asked questions relating to electric deregulation and the expiration of rate caps, electric competition, the health of PGW, and the operations of the commission.

The House Republican Policy Committee held an informational meeting on HB 1909, as a follow up to a House Environmental Resources and Energy Committee hearing held last week. The members heard from three testifiers, all of whom argued that HB 1909 will be detrimental to Pennsylvania and Pennsylvania’s taxpayers.

The House Environmental Resources and Energy Committee held a public hearing this afternoon on HB 1909, which would establish a Commonwealth Energy Advocate. Among its various duties, the new office would represent Pennsylvania’s retail electric customers before the Federal Energy Regulatory Commission (FERC) and regional transmission organization PJM Interconnection to ensure reasonable rates in the face of ongoing electricity deregulation in the state. Governor Rendell announced this afternoon that Harley Davidson’s board of directors met earlier in the day and have ratified a decision to remain at their York plant. He reported he is “gratified” by the news, but expressed disappointment that nearly 950 Harley workers will lose their jobs. By staying in York, Harley will receive $15.4 million in grant money from the state, a “very attractive package” the governor said helped beat back challenges from possible relocation sites in Kentucky and Indiana.
The governor also offered comments on a variety of other issues, including Revenue Secretary Steve Stetler’s invitation to testify before a grand jury on the Bonusgate scandal, table games, rate caps, and the future of DPW Secretary Estelle Richman, who he said has been offered a job with the Obama Administration. House Speaker Keith McCall (D-Carbon) offered remarks at today’s Press Club Luncheon. Speaker McCall offered comments on the state of the budget, the governor’s proposed PIT increase (he is in favor), rate caps, transportation, business taxation and other issues. The committee voted unanimously to report as committed SB 281 which prohibits the Department of Education from directly or indirectly developing or implementing statewide requirements or entering into a contract that provides for graduation competency assessments until specifically authorized by the General Assembly. The members also voted unanimously to report as amended SB 893 which amends The Library Code. Check the Capitol Toolbox later for the full story.

The Senate Consumer Protection Committee met to consider the nomination of Robert Powelson to the PUC. After a few minute of questions, largely pertaining to rate caps, the committee unanimously approved the nomination.

The House Consumer Affairs Committee held a public hearing on HB 20, which provides for the implementation of electricity rates as the rate caps expire. The committee heard from a wide variety of groups, including consumers, electric distribution companies pre- and post-rate caps, industrial users, the PUC, retail energy suppliers, and electric power generators. While there was a general overtone of support for the concept of the bill, several testifiers raised concerns about recovering deferred costs and whether the bill would apply to post-rate cap territories.
